In India, an NGO can register as-

  • Trusts or
  • Societies or
  • Private Limited Company (Sec.8 Companies Act)

According to the Indian Trust Act 1882, a Trust is an arrangement where the trustor transfers the property to the trustee for the benefit of the beneficiary.

Trust is classified into two categories:

 1. Public Trust or

 2. Private Trust

PROCESS OF TRUST REGISTRATION IN INDIA

In India, a Trust is registered and governed by the Indian Trust Act 1882.

Following are the steps to register as a Public Charitable Trust in India-

  1. Choose a name for the Trust.
  2. Decide an author (resident of India) and a minimum of two trustees of the Trust.
  3. Draft a Memorandum of Association and Trust Deed of your Trust.
  4. Submit the required documents at the time of registration.
  5. Prepare Trust Deed on a Stamp Paper.
  6. Submit the Trust Deed along with properly attested photocopies with the local registrar.
  7. Obtain the Registration Certificate from the registrar.

After completing all the above steps, the registration certificate is issued within seven days.
